On 4 November 2025, the European Commission presented its third Report on Ukraine’s alignment with the EU membership criteria.
Key findings of the European Commission relevant to extradition cases:
- Implementation of ECtHR judgments requires improvement.
As of 31 August 2025, 694 cases remain under enhanced supervision by the Committee of Ministers.
Ukraine must address the systemic and structural deficiencies identified by the Court, particularly in the areas of the judiciary, law enforcement, and human rights protection, and ensure the systematic and timely execution of ECtHR judgments.
- Despite certain improvements, torture and ill-treatment remain a systemic problem in Ukrainian places of detention.
Criminal prosecution for such offences must become effective and prompt.
- Detention conditions in penitentiary institutions continue to raise serious concerns and must be brought into compliance with the recommendations of the Committee for the Prevention of Torture (CPT).
- The practical implementation of procedural rights guaranteed under the Criminal Procedure Code of Ukraine continues to suffer from inefficiencies and shortcomings of the judicial system.
Violations of the right to access to justice and to a fair trial, along with excessive length of proceedings and misconduct by law enforcement authorities, remain a serious concern.
