VB Partners has successfully defended the interests of an injured patient in a medical malpractice case. The court ruled to recover a record UAH 5 million in non-pecuniary damage from a private medical clinic — the most significant compensation in this category of cases in Ukraine.
In 2019, VB Partners’ client turned to a private medical institution, where she suffered severe health damage as a result of a medical error during a surgical intervention.
VB Partners has successfully defended the interests of an injured patient in a medical malpractice case. The court ruled to recover a record UAH 5 million in non-pecuniary damage from a private medical clinic — the most significant compensation in this category of cases in Ukraine.
In 2019, VB Partners’ client turned to a private medical institution, where she suffered severe health damage as a result of a medical error during a surgical intervention.
The client’s defence lasted more than 5 years and included:
- claim work
- criminal proceedings
- administrative proceedings
- civil proceedings
The court ruled in favour of the victim based on substantial evidence. Although the compensation of UAH 5 million is a record for Ukraine, VB Partners believes it is insufficient given the severity of the client’s moral and physical suffering.
The law firm hopes this case will become an essential precedent for developing judicial practice in medical liability.
The decision is currently being appealed in the appellate instance, and VB Partners continues to fight for the final restoration of justice.
